The Public Sector Workers’ Trust returned to court on Tuesday, September 24. The trustees were taken back to court after mediation has failed between them and the beneficiaries of the trust. In December 2017, the court had ordered, among other things, that a new trust deed be drafted and that all activities including the use of the trust funds for lending purposes to be discontinued. That was not done and the beneficiaries took the trustees back to court where mediation was ordered. That failed and now they are back in court.
On Tuesday, in-camera meetings were held during which the judge pointed out that his orders were clear and he could not understand why they were not being complied with. With that, he set October 7 when the parties are to return to court. At that time, it is expected that the beneficiaries are to present a consent order. They are asking the court to order distribution of the accumulated funds. They will also seek that an independent actuary be appointed as well as finalizing the list of persons who are to benefit from the fund.
At Tuesday’s hearing, representatives of beneficiaries from all district were present at the Supreme Court.
