The saga over lot 4670 continued in Magistrate’s Court on Wednesday February 6 when 76-year-old Primrose Gabourel and her son, 43-year-old Dion Zabaneh appeared to answer to six charges including the filling of the sea without getting environmental clearance, failure to comply with enforcement notices and assaulting and obstructing an environmental technician.

While they were prepared to argue their case in the Magistrate’ Court through their attorney Emil Arguelles, the matter never made it any further as the Department of the Environment withdrew the charges. Arguelles explained that there was regret that the charges were withdrawn as he claims DOE approval was not needed in the first place.

But things seem to be a bit more complicated than that as a gazette dated November 16, 2006 states under schedule LS7507/222 that all that piece or parcel of land being Parcel No.4670, Block No. 16, comprising 1.35 acres situated in the Caribbean Shores Registration Section, Belize City, Belize District, was being acquired for a public purpose. That publication was repeated in 2007.

At this time, it is uncertain how Gabourel and Zabaneh will proceed but we do know that they have since asked for permission to continue to fill the sea to which they have not yet gotten any answer.
